2. Basis of agreement
These terms of engagement apply to all advisory services and deliverables from HECHT:RIGAS, unless otherwise agreed in writing. The client's own terms do not apply unless HECHT:RIGAS has accepted them in writing.
Each engagement is described in a separate engagement letter setting out the scope of the matter, the services we provide, and any fixed fees. In the event of a conflict between the engagement letter and these terms, the engagement letter prevails unless expressly stated otherwise.
All services are subject to the rules of professional conduct for attorneys and the standards of good legal practice as applicable from time to time.
3. Legal services
Legal services are provided by Nikolas Hecht Rigas, who is admitted to the Danish Bar by the Ministry of Justice and is a member of the Danish Bar and Law Society. Advice is based exclusively on Danish law.
Both parties are required to communicate openly and continuously about matters of material importance to the performance and outcome of the engagement.
4. Fees and invoicing
Fees
Unless a fixed fee is agreed in the engagement letter, the fee is determined on the basis of: time spent, the outcome of the matter, the complexity and size of the matter, the expertise and responsibility required, time pressure, and the value created.
Currency and VAT
Fees are stated in Danish kroner excluding VAT and taxes, unless the client is a consumer, in which case prices are always stated including VAT.
Invoicing
Invoicing takes place monthly as the work progresses, unless otherwise agreed. Payment terms are net 8 days from the invoice date. Late payment is subject to interest in accordance with the Danish Interest Act.
Disbursements
The client covers reasonable travel and accommodation expenses, public fees, necessary access to data and publications, and similar costs incurred in connection with the engagement.
5. Client funds
Client funds are managed in accordance with applicable law and the rules of the Danish Bar and Law Society and are deposited in a client account at SJF Bank (Sparekassen Sjælland-Fyn).
Funds held on the client account are covered up to EUR 100,000 per client per financial institution under the national deposit guarantee scheme. HECHT:RIGAS is not liable for losses arising from a financial institution's insolvency. Any other deposits the client may hold at the same institution are aggregated for the purposes of the coverage limit.
6. Liability for damages
HECHT:RIGAS is liable in accordance with the general rules of Danish law, subject to the limitations below.
HECHT:RIGAS is not liable for indirect losses or consequential damages, including loss of business, loss of goodwill, loss of profit, loss of revenue or loss of data.
If advice is used by third parties or for purposes other than those agreed, HECHT:RIGAS accepts no liability in that regard.
Total liability is limited to the applicable insurance cover of DKK 2,500,000 per attorney per year. Multiple claims within an insurance year may reduce the available cover.
7. Professional indemnity insurance and guarantee
HECHT:RIGAS holds professional indemnity insurance and has provided a guarantee in accordance with the requirements of the Danish Bar and Law Society with CODAN Forsikring DK (CVR 10526949), Midtermolen 7, Copenhagen Ø. Policy number: 913-216-7623.
8. Confidentiality
HECHT:RIGAS is subject to a duty of confidentiality covering all information received from or about the client in connection with the work performed. The duty is continuing and applies after the matter has been concluded.
The duty of confidentiality does not apply to information that HECHT:RIGAS is legally required to disclose to the authorities.
9. Conflicts of interest
HECHT:RIGAS declines matters involving a risk of conflict of interest. The client is required to provide the necessary information prior to commencement so that HECHT:RIGAS can carry out a conflict check.
10. Anti-money laundering
HECHT:RIGAS is required under the Danish Anti-Money Laundering Act to obtain and retain identification documents and identity information about clients. Documentation is retained for at least 5 years after the engagement has ended.
HECHT:RIGAS is legally required to report any suspicion of money laundering or terrorist financing to the relevant authorities.
11. Marketing
After a matter has concluded and the relevant information has been made public, HECHT:RIGAS may refer to the engagement for marketing purposes. Any earlier publication requires the client's consent.
12. Termination
Either party may terminate the engagement at any time. HECHT:RIGAS' termination must comply with the rules of professional conduct for attorneys.
On termination, HECHT:RIGAS is entitled to fees and reimbursement of expenses up to the date of termination. The provisions on confidentiality, fees and related obligations are continuing and do not cease with the termination of the engagement.
13. Intellectual property
HECHT:RIGAS retains all intellectual property and similar rights to the materials produced, unless otherwise agreed in writing.
14. Electronic communication
The parties may use email and electronic means to exchange messages and documents. Sensitive personal data must be sent via encrypted and secure email in accordance with HECHT:RIGAS' instructions. Communication takes place via the electronic addresses provided.
15. Personal data
HECHT:RIGAS processes clients' personal data in connection with the performance of the agreed engagement. The firm is responsible for lawful processing in accordance with applicable data-protection legislation. Please refer to HECHT:RIGAS' data protection notice below.
16. Governing law and venue
All engagements for legal services from HECHT:RIGAS are governed by Danish law, without regard to its conflict-of-laws rules. Disputes are settled by the Danish courts.
17. Complaints procedure
Complaints concerning HECHT:RIGAS should be addressed in the first instance to attorney Nikolas Hecht Rigas at info@hecht-rigas.dk.
If a complaint cannot be resolved amicably, the client may bring the complaint before the Disciplinary Board of the Danish Bar and Law Society (Advokatnævnet):

Purposes of processing and categories of data
HECHT:RIGAS collects, receives and processes personal data about clients, prospective clients and related persons in connection with specific matters and the provision of legal services. The purposes are matter-management and registration in our case-management system, email systems and accounts.
The categories of personal data processed may include:
- Name and address
- Email and telephone number
- Financial interests in companies
- Other information relevant to the specific matter
Retention
Personal data is retained for as long as necessary to fulfil the purposes of processing and as required by law — for client matters typically for at least 5 years after conclusion of the matter, in accordance with the Danish Bookkeeping Act and the rules of professional conduct for attorneys.
Your rights
As a data subject you have the right to access, rectification, erasure, restriction, data portability and to object to processing. Exercise of these rights may in certain cases be restricted by the requirements of legal practice.
Requests concerning your rights should be sent to info@hecht-rigas.dk. We will respond to requests no later than within 30 days.

What we collect
When you visit our website or contact us via the contact form or by email, we may collect the following information:

We do not collect personal data without your active participation, and we do not use automated profiling or decision-making.
Purpose and legal basis
Personal data from website enquiries is processed for the purposes of responding to your enquiry and assessing a possible engagement. The legal basis is legitimate interest under Article 6(1)(f) of the GDPR, alternatively your consent in the case of voluntary contact.
Technical log data is processed on the basis of legitimate interest for the purposes of operational reliability and security of the website.
Retention
Enquiries that do not result in a client engagement are deleted no later than 12 months after receipt. Where a client engagement is established, the data is transferred to processing under the data protection notice for clients.
Your rights
